公有地  古代罗马土地所有制中属于罗马国家的土地。早在王政时代(公元前8~前6世纪),罗马即有氏族部落公社成员份地和公有地(未分配的耕地、牧场、荒地等)之分。进入共和时代后(约公元前 509),随着对外扩张,公有地日益增加。罗马征服意大利期间,通常没收敌对的公社或部落1/3的土地归罗马国家所有。在其后海外扩张中设置的行省内,按照罗马的法律,土地名义上都属于罗马国家。其中除农民实际耕种而向国家纳税的那部分外,罗马直接控制的公有地有没收政敌的地产、被征服国家(例如迦太基)的土地以及被推翻的马其顿、埃及等王室的土地。    在罗马共和早期,贵族依恃财势大量占用公有地,平民则不断为争取公有地的占用权而斗争。公元前 367年通过的《李锡尼-塞克斯都法》规定,每户占用公有地的最高限额为 500尤格(1尤格合1/4公顷)。但在此后,贵族却继续超占。罗马当局将公有地用来设置拉丁殖民地和罗马公民殖民地,或由监察官主持向公民出租或拍卖;公元前1世纪起又用来安置退役士兵。元老贵族和骑士乘机承租或收购大片公有地,经营奴隶占有制庄园和牧场,发展成为大地产制。格拉古兄弟改革重申限田和均田之法,均告失败。公元前111年的《托利乌斯法》规定,公民份地和在限额内占用的公有地皆为私有,可以转让或买卖。在帝国时期(公元前27~公元476),很大一部分公有地转化为皇室领地。
