专利制度 国际上通行的一种利用法律的和经济的手段确认发明人对其发明享有专有权，以保护和促进技术发明的制度。 最早实行专利制度的是威尼斯，它在1474年颁布了第一部具有近代特征的专利法。以后，专利制度在世界各国得到了广泛的应用。为了促进国际交流合作和技术贸易，各国先后签订了一些有关保护工业产权的国际公约。1883年，在巴黎由法国等11个国家缔结的《保护工业产权巴黎公约》（简称《巴黎公约》）是第一个也是至今为止最重要的国际专利公约，截至1984年已有94个国家参加。1980年,中国成立了专利局,1984年颁布了《中华人民共和国专利法》，1985年加入了《保护工业产权巴黎公约》。 专利制度的基本内容是：依据专利法，对申请专利的发明，将其要点写成详细说明，公诸于世，征询异议，经过审查和批准后，授予发明者以专利权。这些权利包括：非经专利权人同意，其他人不得制造和销售专利产品，或使用专利方法；如他人要使用某项专利，就要取得专利占有人许可并付给一定报酬,承担一定的义务;如他人侵犯，则要受到法律的追究。 在中国，申请专利的技术发明的条件是：①新颖性。在申请日以前没有同样的发明在国内外出版物上公开发表过、在国内公开使用过或者以其他方式为公众所知，也没有同样的发明由他人向专利机构提出过申请并且记载在申请日以后公布的专利申请文件中。②创造性。同申请日以前已有的技术相比，该发明有突出的实质性特点和显著的进步。③实用性。该发明能够制造或者使用，并能产生积极效果。 为了推动技术进步，各国对享有专利权的期限都作了规定，一般是10～20年，专利权期满以后，专利就归社会所有和使用。 实行专利制度，有利于鼓励创造发明，有利于先进技术的推广，有利于引进国外的先进技术。
