灰暗区贸易限制措施灰暗区贸易限制措施 灰暗区贸易限制措施《关税及贸易总协定》范围之外，不受总协定法律规则管辖与监督的保护性贸易限制措施。 《关税及贸易总协定》第十九条“对某种产品的进口的紧急措施”规定，缔约方在进口商品对国内生产者造成重大损害或产生重大的威胁时，可以援用保障条款，采取撤销关税减让或实施进口数量限制的保护性措施。同时又规定了实施过程中应遵循的主要规则:①保护措施应具有透明度。实行保护的国家，在采取行动以前，应尽可能提前用书面通知缔约各方②实行保护的国家在采取措施前应同有关缔约方协商，但在紧急情况下，可以先采取保护措施，随后立即进行协商。③其他缔约方因该项紧急保护措施受损害时，如经双方协商未能达成协定，可以采取对等的报复措施。为避免受到上述规定的约束，保护国内生产者，从70年代中期开始，发达国家纷纷采取“自动出口协定”、“自动出口限制”、“有秩序销售安排”以及由政府认可或支持的“出口卡特尔”或“个别生产行业间的销售安排”等措施。这些措施由于不受关税及贸易总协定的法律约束，实施前后根本不用通知其他缔约方，因而缺乏应有的透明度。甚至有些措施连政府是否参与都模糊不清，故被通称为灰暗区贸易限制措施。它的实施导致了关税及贸易总协定多边法律体系的失效，因此其合法性一直是多边贸易谈判争论的一个重要议题。
