土地征用土地征用land expropriation tudi zhengyong土地征用(landexPr’Opnation)在中国，根据经济、文化、国防建设以及兴办社会公益事业的需要，依照法律程序和审批权限，将集体所有的土地转为国有土地的一项措施。《中华人民共和国宪法》第10条规定:“国家为了公共利益的需要，可以依照法律规定对土地实行征用。”《中华人民共和国土地管理法》第2条规定:“国家为了公共利益的需要，可以依法对集体所有的土地实行征用。” 土地征用的特征表现为:①采取行政手段，具有一定的强制性。②土地征用是土地所有权的转移。《土地管理法》第解条规定:“国家建设征用的集体所有的土地，所有权属于国家，用地单位只有使用权。”③对被征地单位给予合理补偿，并妥善安t群众的生产和生活。④土地征用法律关系主体双方是特定的，征用方只能是国家，其他任何单位和个人都无权征用，被征地方只能是所征土地的所有者，即农民集体。 土地征用必须遵循的原则是:①坚持法定程序和审批权限原则。国家建设征用土地的审批权限依照法律规定:征用耕地10以〕亩以上，其他土地20以〕亩以上，包括一个建设项目同时征用耕地l(X幻亩以下和其他土地l(X幻亩以上合计为2仪0亩以上，由国务院批准;征用省、自治区、直辖市行政区域内的土地，由省、自治区、直辖市人民政府批准;征用耕地3亩以下，其他土地10亩以下，包括一个建设项目同时征用耕地3亩以下和其他土地10亩以下合计为3亩以上10亩以下，由县级人民政府批准。②贯彻节约用地原则。③兼顾国家、集体、个人三者利益的原则。 世界上大多数国家和地区都采取土地征用措施，以保证兴办社会公共事业和实施国家经济政策的需要。如美国的“最高土地权”的行使，日本的土地收买，德国、法国、巴西等国的土地征收，英国的强制收买，香港地区的官地收回，新加坡的土地征用等。 征地费是建设单位依法向被征地单位支付的因征用土地而产生的各项费用的总和。包括土地补偿费、安置补助费、青苗补偿费、地上附着物和林木补偿费等。 耕地占用税是国家对占用耕地建房和从事非农业建设的单位和个人征收的一种税。其目的是保护农用耕地，控制非农业建设对耕地的占用。耕地是指种植农作物的土地，包括菜地、园地和占用前3年内曾种植农作物的土地;占用鱼塘及其农用土地(如已开发的滩涂、草场、水面)也视同占用耕地。税额以纳税人实际占用的耕地面积计算，按法定税额一次性征收。 耕地补偿费是国家建设征用耕地时，用地单位对被征地单位在被征用之耕地上长期投人的补偿。耕地补偿费的补偿标准为该耕地被征用前3年平均年产值的3~6倍，年产值按被征地前3年平均年产量和国家规定的价格计算。 (严星王春立)
