违法占地行为的处罚 城市规划区范围内的土地一般都十分紧张和珍贵，一旦失去规划控制和管理，就会严重影响城市规划的实施和城市建设的综合效益，造成土地浪费。因此，《城市规划法》第三十九条专门规定了对于违法占用土地的处罚措施。各级城市规划行政主管部门，都必须重视和加强对于城市规划内土地的规划管理，及时依法严肃处理违法占用城市土地行为。 根据各类不同的违法占用城市土地的行为，城市规划行政主管部门可以采取不同的处罚方式。 1．城市中一切单位或个人，在未经任何申请或批准的情况下就擅自占用城市规划区内土地进行建设或从事挖取砂石、土方等活动的，一经检查发现，城市规划行政主管部门就应责令有关当事人立即停止违法活动；对于违法占用的土地，要依法提请县级以上人民政府收回3对于违法占用土地上已经形成的各种建筑物、构筑物和其他设施，要根据具体情况处以限期拆除或没收的处罚；对于破坏城市原有地形地貌和环境的，要责令有关当事人限期恢复原状。 2．对未向城市规划行政主管部门提出申请，未取得建设用地规划许可证的违法占用的土地，要责令有关当事人停止违法活动，提请县级以上人民政府收回；对于申请建设的，一律不予审批；对于擅自建设已经形成的建筑物、构筑物和其他设施，要根据具体情况处以限期拆除或没收的处罚；同时城市规划行政主管部门还可以提请城市人民政府追究有关违法批准机关直接责任人员的行政责任。 3．建设用地规划许可证所确定的有关建设用地的位置、面积、范围等要求具有法律效力，在征用、划拨用地的具体过程中，如果确需对建设用地规划许可证的要求做出局部调整的，必须按照一定的程序，经过城市规划行政主管部门的审查批准并办理必要手续，有关土地的使用方为有效。凡未经城市规划行政主管部门批准就擅自改变建设用地规划许可证要求的，城市规划行政主管部门必须责令有关当事人采取改正措施，在未改正前，对其建设申请一律不予审批。 4．未经城市规划行政主管部门审查批准，就擅自改变已经确定的土地使用性质的，城市规划行政主管部门应责令有关当事人限期纠正；对于已经形成的各类建筑物、构筑物或其他设施，按违法建设进行处罚。 5．无理拒不服从城市人民政府调整用地决定，影响城市规划实施的，城市规划行政主管部门就应当责令有关当事入限期执行决定。
